Merdeka.com – The election of Atnike Nova Sigiro as Chair of the National Human Rights Commission (Komnas HAM) raises a question, because it is considered to violate the rules of the mechanism for appointing the chairman of the institution.

Responding to this, Atnike admitted that he would provide an explanation after he and the eight elected Komnas HAM commissioners for the 2022-2027 period had been officially sworn in.

“I’m sorry, at this time I can’t provide information. But in time, I along with other elected commissioners will provide information,” said Atnike to merdeka.com, Friday (7/10).

In line with Atnike, Pramono Ubaid Tanthowi, the elected Commissioner of the National Human Rights Commission, was also reluctant to comment on Atnike Nova Sigiro who was lined up as Chairman of Komnas HAM for the period 2022-2027.

“Well, if that’s the case, please ask Commission III of the DPR. I haven’t been sworn in yet. So I don’t feel entitled to answer yet,” said Pramono.

Although he did not want to comment on the question of the election of Atnike Nova Sigiro. However, Pramono emphasized that the selection process for members of the National Human Rights Commission for the period 2022-2027 carried out by the Pansel had been carried out openly according to the rules.

“Who said it was closed? All the selection processes at the Pansel were open. Even the public was involved in one of the selection processes, namely the public test,” he said.

“Candidates are asked to explain their vision and mission in front of a general audience, then the audience may ask questions. How do you say it’s closed?” he added.

It should be noted that Commission III of the DPR has determined the names of nine candidates for Komnas HAM members for the 2022-2027 period. Commission III has chosen based on the results of the fit and proper test which has been held since last Friday, September 30.

The nine names are Abdul Haris Semendawai, Anis Hidayah Atnike Nova Sigiro, Hari Kurniawan, Prabianto Mukti Wibowo, Pramono Ubaid Tanthowi, Putu Elvina, Saurlin P Siagian, Uli Parulian Sihombing. Atnike Nova Sigiro was appointed chairman.

Typhoon Damanik’s critique

Previously, the Chairman of Komnas HAM Ahmad Taufan Damanik considered that the election of Atnike Nova Sigiro as Chairman of the National Human Rights Commission for the period 2022-2027 violated the rules. Damanik said the election of the chairman must be done through an internal mechanism.

“There it is clearly written that the Election of the Chair and Deputy Chairmen are elected from and by members. In the Komnas HAM Tatib Article 22 paragraph 2 it is also explained that selecting the Chair and Deputy Chairperson of Komnas HAM are commissioners at the Plenary Meeting (internally Komnas HAM),” said Taufan told merdeka.com, Wednesday (5/10).

It has been regulated in Law 39 of 1999 article 83 paragraph 3, it is written “(3) The chairman and deputy chairman of Komnas HAM are elected by and from the members.”

Then it was embodied in Komnas HAM Regulation Number 2 of 2019, Article 22 Paragraph 2. “The Chair and 2 (two) Deputy Chairmen are elected by Komnas HAM Members in the Plenary Session.”

As a result, the election of Atnike Nova Sigiro as chairman of the National Human Rights Commission violated the Paris Principles. That all Komnas HAM in the world are required to be independent.

“Therefore, the DPR’s intervention in the election of the chairman can be seen as reducing the independence of the Indonesian National Human Rights Commission, which is now accredited A,” said Taufan.

Taufan assessed that the DPR’s political steps could be considered as an intervention step that weakens Komnas HAM. Because from the very beginning the election of the Chairman of Komnas HAM was different from other institutions.

“Just look at the Komnas HAM Pansel which is different from the KPU or the KPK where the Pansel is formed by the government. But for the Komnas HAM it is fully formed by the Komnas HAM Plenary Session. That is the autonomy of this institution, beyond the independence of other state institutions such as the KPU and the KPK,” he explained.
